SleekVPS operates the website https://sleekvps.com. We operate under the company name Sleek Designs LLC with our registered office in Pennsylvania, United States. By placing an order, you also consent to receiving service-related communications by email, our primary way of informing you about service updates, billing changes, planned maintenance, and account access details.
These terms are governed by the laws of the Commonwealth of Pennsylvania (and applicable United States federal law), and any disputes will be subject to the jurisdiction of the courts located in Pennsylvania, unless otherwise required by law. English is the language used for forming these contracts.
2. Your Status
By placing an order via our website, you warrant that you are legally capable of entering into binding contracts, you are at least 18 years old, and if ordering on behalf of a company or business, you have the authority to bind that entity.
3. The Order Process
You must register an account with us before placing an order. All details provided during registration must be accurate and complete. We reserve the right to block access if we suspect any inaccuracies. You are responsible for keeping your login details confidential and must contact us immediately if you suspect any unauthorized use.
Prior to submitting your order, a summary will be displayed detailing the services you wish to purchase along with the applicable price, and you will have the option to amend any errors.
A valid payment method must be registered with your account before you can complete an order. Accepted payment options may be shown in your client portal or during checkout.
Once an order is placed, you will receive an email confirmation sent to the address registered with your account along with copies of invoices stored in your account.
4. Formation of the Contract
After your order is placed, you will receive an email from us confirming acceptance of your order and, if applicable, the activation of your Hosting Service ("Acceptance Confirmation"). Your order constitutes an offer to purchase our services and a contract ("Contract") is formed only upon our sending the Acceptance Confirmation. We reserve the right to decline any order.
The Contract applies only to the services specified in the Acceptance Confirmation. Any additional services in your order may require separate confirmation.
5. Our Role
We may include links to third-party websites on our site. We do not guarantee that products or services purchased through these links will be satisfactory, and we disclaim any warranties regarding them. This does not affect your statutory rights.
6. Consumer Rights
If you are buying as a consumer (i.e., not for business purposes), you may have certain statutory rights, including cancellation rights where required by law. Some digital services may begin immediately upon purchase or activation.
By placing your order, you agree that we may begin supplying the services as soon as your order is accepted and activated. This means that where permitted by law, your cancellation rights may be limited once performance begins.
7. Limited Money Back Guarantee
After the Contract is formed, new customers may cancel an eligible Hosting Service within 30 days from the day after you receive the Acceptance Confirmation and receive a refund credited to your original payment method. This offer is limited to one refund request per customer, unless otherwise required by law.
To request a refund, please raise a support ticket within the 30-day period or email contact@sleekvps.com. You may be required to reconfirm your cancellation request; failure to do so may result in the continuation of the Hosting Service.
Eligible Hosting Services include Shared Hosting, Shared WordPress Hosting, VPS Hosting, and Cloud Hosting, unless otherwise stated at the time of purchase.
This guarantee does not apply to Domain Registration and Renewal Services, and does not apply to add-on products (including but not limited to SSL certificates, email add-ons, backups, licenses, and third-party services).
Refunds will be denied if there is a violation of these terms, our Acceptable Use Policy, or if we detect abuse, spam, phishing, malware distribution, fraud, or excessive resource usage that negatively impacts server performance or other customers. We reserve the right to deny refunds in cases of abuse or fraud.
8. Pricing and Payment
Service prices are as quoted on our website and will be clearly displayed before you confirm your order. Prices may change, and where applicable we will notify you in advance of renewal pricing changes in your client portal and/or by email. If you do not wish to renew at the updated price, you must cancel before the renewal date.
In cases of pricing errors, if the correct price is lower, you will be charged the lower amount. If it is higher, we will contact you for instructions before finalizing your order. We are not obliged to honor an incorrectly low price.
Payment is deemed received only when cleared funds are confirmed. If payment is not received on time, we may suspend or terminate services.
9. Cancellation
You may cancel services through your client portal or by submitting a support ticket. Cancellations must be made prior to the renewal date to prevent automatic renewal charges. You are responsible for ensuring your cancellation request is submitted correctly and received.
If a problem arises, you must notify us in writing (support ticket or email), and we will use reasonable efforts to resolve the issue. Where appropriate and consistent with these terms and our Refund Policy, we may provide a refund or credit.
By accepting these terms, you acknowledge that you have not relied on any statement or promise other than what is expressly provided on our website or confirmed in writing.
10. Access to Hosting Services
It is your responsibility to ensure that all necessary arrangements for accessing our Hosting Services are in place. You must also ensure that everyone accessing the services via your internet connection is aware of these terms and our acceptable use policy.
11. Service Levels
We will use reasonable endeavors to keep our servers accessible, but we do not guarantee uninterrupted or error-free service. We may perform maintenance that could affect service availability, and we will aim to provide notice when feasible.
12. IP Addresses
Any IP address allocated as part of your Hosting Service remains the property of SleekVPS and is non-transferable. Should an IP address be re-assigned, we will make reasonable efforts to minimize disruption.
13. Data Backup and Server Material
You are responsible for maintaining up-to-date backups of any data or content you upload to our servers. Although we may provide backup tools within our control panel, we are not liable for any loss or damage arising from backup failures, user error, or third-party compromise.
14. Usage Limitations
The Hosting Service package you order includes a monthly bandwidth allowance as specified on our website. Exceeding this limit may result in suspension until the start of the next billing period. You may choose to upgrade your package if needed, and you can monitor your usage via your control panel.
We may apply reasonable usage and resource limits to protect platform stability. If your usage is excessive and negatively impacts server performance or other customers, we may throttle, suspend, or require you to upgrade.
You must comply with our Website Terms of Use and Acceptable Use Policy. A breach of these policies may result in suspension or termination of the services.
15. Support
Our support team is available to help resolve issues with the services. Please note that we do not provide programming support. Support is provided through our online ticket system, email, and available live chat options (where offered).
16. Domain Names
For Domain Registration and Renewal Services, we will endeavor to register the domain name you request. We are not liable if the domain registry refuses registration or later suspends the domain. Domain registration is subject to the registry’s terms, which you must follow, and registration is confirmed only when your details appear in the appropriate "whois" database. You warrant that you own any trademark used in the domain name or have the necessary permissions.
Domain names must be renewed periodically. Renewal notices may be sent prior to renewal. You authorize us to renew your domain registration where auto-renew is enabled in your account, unless you cancel the service before the renewal date.
17. Intellectual Property Rights
You retain all intellectual property rights in your content while granting us a worldwide, non-exclusive, royalty-free license to use, store, and display your content for providing our services.
You warrant that your content does not infringe any third-party rights and agree to indemnify us against any related claims. We retain all intellectual property rights in our services and software. You must not decompile or reverse-engineer our software except to the extent permitted by law.
18. Acceptable Use
You agree not to use our services for unlawful, abusive, or harmful activities. This includes but is not limited to spam, phishing, malware distribution, unauthorized access attempts, illegal content, or activities that violate the rights of others. If we reasonably believe your use violates these terms or harms our network or other customers, we may suspend or terminate your services.
19. Suspension and Termination
We reserve the right to suspend or terminate services immediately where necessary to protect our network, comply with law, respond to abuse, or address non-payment. Where appropriate, we may provide notice and an opportunity to remedy the issue. Refunds may be denied where suspension or termination results from a violation of these terms or abuse.
20. Limitation of Liability
To the maximum extent permitted by law, SleekVPS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the services will not exceed the amount you paid to us for the affected service during the billing period in which the event giving rise to the claim occurred, unless otherwise required by law.
21. Written Communications
By using our website, you consent to receive electronic communications, including emails and online notices, from us, which will satisfy any legal requirement for written communication.
22. Notices
All notices from you should be submitted via our support ticket system or by email. We may contact you at your current email or postal address registered with your account.
23. Third-Party Rights and Assignment
No term of this Contract is intended to benefit any third party. This Contract is binding on both parties and their respective successors. You may not transfer any rights or obligations under this Contract without our prior written consent, though we may assign or subcontract our obligations at any time.
24. Events Beyond Our Control
We will not be liable for delays or failures to perform due to events beyond our reasonable control ("Force Majeure Events"), including unauthorized interference with our servers, strikes or industrial action, civil disturbances, terrorist threats or war, natural disasters, failures of public or private telecommunications networks, or government actions and regulatory restrictions.
During a Force Majeure Event, our obligations will be suspended for the duration of the event, and we will use reasonable endeavors to resolve the situation as soon as possible.
25. Waiver
Our failure to insist upon strict performance of any obligation under these terms does not constitute a waiver of that right. Any waiver must be expressly stated in writing.
26. Severability
If any provision of these terms is found to be invalid or unenforceable, that provision will be severed and the remainder will continue in full force and effect.
27. Entire Agreement
These terms, along with any documents expressly referenced herein, constitute the entire agreement between you and SleekVPS, superseding all previous agreements or understandings.
28. Changes to These Terms
We reserve the right to revise these terms and conditions from time to time. You will be subject to the version in effect at the time of your order unless changes are required by law, in which case they will apply as required. Any updated terms will be posted on this page.
